What&#039;s different now, among other things, is that the ease with which we can make, keep, and redistribute copies of these performance and, most importantly, the copies are loss-less. Not long ago, Grateful Dead fans employed a samizdat model of exchanging tapes, making copies of copies. The value of a particular tape was derived, in part, by how few generations the recording was removed from the original (a recording often make directly from the sound engineer&#039;s mixing board). The same applies to recorded TV shows, movies, and live performances. Once the recording is made, the incremental cost of making new copies is next to nil. This has made online piracy practical for the first time.
Also, the recording industries, particularly RIAA, have been so ham-handed in their responses that they&#039;ve bred a culture of mistrust that makes piracy almost an act of freedom fighters. In their hey-day, music companies made obscene amounts of money, charging $15 in 1985 dollars for a product that cost them $3 to produce. It&#039;s almost impossible to view the RIAA&#039;s response as anything but an effort to protect their outrageous profit margins.
So, the recording industry undermined a very real legal and even moral case by managing to abuse both performers and consumers. Obviously, piracy isn&#039;t a legitimate response, but the industries made it almost inevitable.]]></description>
